Refunds and Return Policy

1. Requesting Returns/Refunds

1.1. Provided that the conditions stated in this Refunds and Return Policy and the Terms of Service are met, the buyer can apply for a return or refund of the purchased items ("Item") before the expiration of the BayV Guarantee Period mentioned in the Terms of Service.

1.2. BayV Guarantee is a service offered by BayV upon user's request to assist in resolving conflicts that may arise during a transaction. Users have the option to privately communicate with each other to resolve disputes or seek assistance from local authorities before, during, or after using BayV Guarantee.


2. Applying for Item Returns

2.1 Buyers can request a refund or return of the Item in the following circumstances:

  • 2.1.1 The Item has not been received by the buyer.

    2.1.2 The Item was defective or damaged upon delivery.

    2.1.3 The seller provided an Item that does not match the agreed-upon specifications (e.g., incorrect size, color, etc.).

    2.1.4 The Item delivered to the buyer significantly differs from the description provided by the seller in the listing.

    2.1.5 By reaching a private agreement with the seller, and the seller confirms the agreement to BayV.

2.2 Buyers must submit their application through the BayV mobile app.

2.3 Please note that if requested by BayV, the buyer must ship the Item to a location specified by BayV within ten (10) calendar days after raising the return request.

2.4 The approval of a refund and return request is solely at BayV's discretion. The buyer acknowledges and agrees that BayV's decision is final and binding. The buyer also agrees not to take legal action or assert any claims against BayV or its affiliates regarding such decisions. If the buyer has initiated legal action against the seller, they can provide formal notification from the appropriate authority to BayV, requesting the continued holding of the purchase funds until a formal determination is available. BayV will determine whether to continue holding the funds at its discretion.


3. Rights of Preferred Sellers

3.1 If you are a Preferred Seller, you should have received a separate written notification from BayV informing you of your selection to participate in the BayV Preferred Seller Program. If you choose not to participate in the program, please inform BayV in writing. Failure to notify BayV will be considered as your agreement to continue participation in the program and acceptance of the terms and conditions outlined in this Refunds and Return Policy. BayV reserves the right to suspend or remove any Preferred Seller from the program at any time, at its sole discretion.

3.2 A refund or return approval from BayV, as outlined in Para 2, is binding on the relevant Preferred Seller. Preferred Sellers agree to comply with the approved refund or return request and take necessary actions to facilitate the process.

3.3 For any refund or return request approved by BayV, the Preferred Seller will be notified via email. BayV will arrange the delivery of the returned Item to the Preferred Seller's provided address for the completion of the refund and return process, as long as the address is within the country where the Item was listed for sale on the site. If the Preferred Seller fails to provide a local address for the return or fails to accept the delivery within a reasonable time determined by BayV, BayV reserves the right to dispose of the Item as it sees fit, and the Preferred Seller forfeits all rights to the Item.

3.4 The Preferred Seller must notify BayV within seven (7) days of receiving the email notification if they do not receive the returned Item. Failure to notify within the specified period will be considered as acceptance of the Item's delivery, and the Preferred Seller agrees not to make any claims or disputes regarding the Item.

3.5 However, BayV may, at its sole discretion, determine that a returned Item approved for refund or return should not be returned to the Preferred Seller, in which case the Preferred Seller forfeits all rights to the Item.

3.6 If a refund or return request is rejected by BayV, and the Item has been received by BayV, BayV will arrange the delivery of the Item to the relevant buyer's address as described in Para 2.

3.7 In the case of a refund or return request approved by BayV, the Preferred Seller can appeal the decision by contacting BayV and providing supporting evidence. If BayV upholds the appeal, the purchase funds will be disbursed, in whole or in part, to the Preferred Seller. The Preferred Seller acknowledges and agrees that BayV's decision is final and binding, and they will not initiate any legal action or assert claims against BayV or its affiliates regarding such decisions.


4. Rights of Ordinary Sellers

4.1 For the purpose of this Refund and Return Policy, Ordinary Sellers refer to sellers who are not Mall Sellers or Preferred Sellers.

4.2 When BayV receives a return or refund application from a buyer, BayV will inform the seller in writing. The seller can respond to the application according to the steps provided in the written notification from BayV. The seller must respond within the specified time-frame (the "Stipulated Period"). If BayV does not receive a response from the seller within the Stipulated Period, BayV will assume that the seller has no response and will assess the buyer's application without further notice. BayV will review each seller's response on a case-by-case basis and determine, at its sole discretion, whether the buyer's application is valid based on the seller's circumstances.


5. Condition of Returned Item

5.1 To ensure a smooth return process, the buyer should return the Item, including any complimentary accessories, in the same condition it was received upon delivery. It is recommended for the buyer to take a photo of the Item upon receipt.


6. Responsibility for Product Return Shipping Fee

6.1 If the seller is responsible for an unforeseen error (e.g., damaged, faulty, or incorrect product delivered), the seller will bear the buyer's return shipping fee.

6.2 If the buyer changes their mind, they must obtain the seller's consent before making the return request, and the buyer will bear the return shipping fee.

6.3 If there is a dispute between the seller and buyer regarding the party liable for the return shipping fee, BayV will, at its sole discretion, determine the responsible party.


7. Refunds

7.1 The buyer will receive a refund once BayV receives confirmation from the seller that they have received the returned Item. If BayV does not hear from the seller within a specified time, BayV may refund the applicable amount to the buyer without further notice to the seller. The refund will be made to the buyer's credit/debit card or designated bank account, depending on the applicable method.


8. Communication Between Buyer and Seller

8.1 BayV encourages users to communicate directly with each other if any issues arise during a transaction. As BayV serves as a platform for trading, buyers should contact sellers directly for any issues related to the purchased Item.
